President Biden Extends the COVID-19 Eviction Ban

The New Executive Orders

On January 20, 2021, Joe Biden was inaugurated as the 46th president of the United States. The President has since signed 17 executive orders. These executive orders bring about many new changes to housing policies around the country. First, President Biden directed the CDC to extend the nation’s ban on COVID-19 and pandemic related evictions through March 2021. Second, homeowners can now apply for mortgage forbearance if they need it. This means that homeowners can apply to have their foreclosure delayed, allowing them to stay in their homes longer. These changes provide much needed relief to renters across the country. This is a safer option for everyone as it will contribute to the stopping of COVID-19. People are safer the longer they stay in their homes, and these executive orders allow them to do so.

How To Know if You Qualify:

The eviction ban provides protection for many renters, but not every renter. To know if you are eligible, first check if your city, county, or state has their own eviction ban currently because those protections will likely be stronger than ones at a federal level. The CDC outlines that eligible renters are those

  • who cannot pay rent due to medical expenses or considerable loss of income

  •  individuals who made less than $99,000 in 2020

  • families that collectively made less than $198,000

  •  individuals who were not required to report income in the 2019 tax year

  • Individuals who would be homeless or would be living in a crowded housing situation if evicted

Double check on the CDC website for all eligibility requirements

After Determining Eligibility:

Fill out the CDC declaration form and give it to the landlord trying to evict you. This can be done in person or electronically.

If your landlord is still trying to move forward with the eviction, consult legal assistance.
